PGA Tour countersuit alleges LIV Golf incited players to break agreements

PGA Tour: A 71-page document submitted by the PGA Tour on Wednesday in response to the antitrust action lodged in U.S. District Court last month contained a counterclaim for contractual interference against LIV Golf.

11 Tour members who had been suspended for breaking the rules and participating in the LIV Golf league initially brought the action, and the Tour’s answer stated the players had been aware of the rules violations.

The statement stated that LIV was asking the court to overturn these perfectly legal requirements with the stroke of a pen after paying hundreds of millions of dollars in Saudi money to the remaining player plaintiffs to break the same rules. Eight of the original eleven players have already withdrawn their names from this action. “The player plaintiffs that have remained in the case seek simply to benefit themselves in utter contempt of the obligations they made to the Tour and its members when they joined the Tour,” the lawsuit reads.

Matt Jones, Bryson DeChambeau, Peter Uihlein, and LIV Golf, who entered the action last month, are the remaining plaintiffs after Phil Mickelson, Talor Gooch, Hudson Swafford, and Ian Poulter withdrew from it earlier this week.

The Tour further noted that while LIV Golf is contesting the media rights rules of the circuit, the start-up league has rules that are “in fact significantly more restrictive” than those of the Tour.

The Tour claims that LIV Golf urged players to break the Tour’s rules in the counterclaim, which calls for a jury trial and “damages… including lost earnings.”

Talor Gooch’s contract with LIV Golf, which mandated him to “help [LIV] in endeavouring to entice players to enter into multiyear player participation agreements with [LIV],” was also included in the counterclaim.

The Tour said LIV Golf misled players into thinking they could play both a full LIV Golf schedule and the PGA Tour, persuading them “they may openly breach their contractual duties to the Tour.”
